Terms of Service

Online Search Services Limited acts as a procurement agent for our business clients in obtaining UK property documents from HM Land Registry. The documents we procure include but are not limited to title registers, title plans, leases, deeds, conveyances, agreements, and other documents held by HM Land Registry. Our services are intended for use by businesses ("Clients") and are not offered to consumers.

Following an initial sales enquiry, we agree terms with each Client in writing. Once the engagement is in place, the Client sends each document instruction to us by email. Instructions must be in writing; we do not act on verbal instructions. Each instruction is subject to our acceptance. For larger batches or less common document types we shall confirm the expected turnaround before placing the order.

Our fees comprise (a) the cost of each document, being the fee charged by HM Land Registry, and (b) our service markup, as agreed in writing with each Client.

Clients provide advance payments based on their anticipated document needs for the coming period, and we issue an invoice for each advance payment. At the end of each calendar month we issue a reconciliation statement showing the advance payments received, the amounts paid for documents and any resulting balance. Any surplus carries forward to the following period. Invoices are issued in GBP, USD or EUR, as agreed in writing with each Client. There are no subscription fees, platform fees or minimum commitments.

Payments are accepted only from the Client's own business account or card. We do not accept payments from third parties. We are a business-to-business service and there are no refunds. Orders executed and delivered are final, including where the instruction was incorrect (see clause 5). Only in the event that the Client ceases to be a client is any remaining balance returned to the bank account or card from which it was paid.

Documents will be delivered as PDF files to the email address agreed with the Client. Title registers and title plans are typically delivered within one business day. Delivery times for other document types, and for large batches, depend on the type and availability of the documents requested, and we shall confirm them before placing the order. We shall keep the Client informed of the progress of any instruction in flight.

The Client is responsible for providing accurate property details when submitting instructions. We are not liable for delays or additional disbursement costs arising from incorrect or incomplete information provided by the Client.

If we are unable to procure a requested document, the Client will be notified and no markup will be charged in respect of that instruction. Where a document has been successfully delivered, both the document cost and our markup are charged in full and are non-refundable.

Online Search Services Limited provides documents as obtained from HM Land Registry. We do not provide legal advice and are not responsible for any decisions made based on the documents we supply. Our liability is limited to the amount paid for the specific service in question.

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page with an updated revision date. Your continued use of our website following any changes constitutes acceptance of the updated Terms.
